Web Site Copy Protection - 1/7/2003 14:38:52
Hello All...............

I recently had my web site " stolen" .........*&&%$$##!!!

I got a bunch of good ideas on how to deal with it from readers of this forum for which I am most grateful!!

I know the WWW is by design " free for all" but I wonder if there is any way I protect any part of my web site from access/theft............ I have an ecommerce site and I can' t get into any kind of restrictive membership, password requirements, etc.

I' ve heard there is a way you can protect certain items, such as images for example, so if someone tries to right click and " borrow it" .........it just won' t work.

Can anyone give me a suggestion or two as to what can be done and/or where I can go to find out how to implement it??

Very much appreciate any input!

Short answer - No. You can make a directory password protected and that will keep 99.9% of the people out.
Without passwording it - Big No!

People do not need to put much effort at all into stealing your web - all they need to do (even if you have " no right click" on individual items) is choose File > Import > From Web ... and then they can sit back comfortably and watch while FrontPage downloads ALL the linked files in your site.

I know only too well, as this happened to me late last year.:):) I found it by checking my site in a search engine one day and being very surprised to see another site with identical description to mine. What was worse, is I have known the person who did it for nearly 10 years!:):)

Yikes! That hurts. :)

It can help to put a certain phrase on a page (or all pages) that the thief may not think about changing... Google is good about " bringing up defined phrases" .

Just this week I found two different SEO companies had copied content from my site. One of the companies copied my verbiage verbatium, the other changed a word here and there but left the style, positioning and even the typos in the text he stole.

When I found out, I contacted several people I felt would give me good advice on how to handle this. All agreed I should copy my attorney on the inital notification email AND- it was suggested I cc the spamreport email from Google as well.

Since Google will penalize a site for mirror content, you should be proactive and let them know the sites carrying your content are doing so without your consent. It also notifies them of the infraction.

If your site is copyrighted and the copyright has been registered, you can take this paperwork and fax it to the ISP hosting your stolen content. BY LAW, they have to take the site down until the situation has been resolved. This is part of the Digital Millennium Copyright Act.

One other little trick I used - I went to archive.org and took a screen shot of my site as they showed it. My site has been up for a year before the creep who stole my content even went online, further proving the content was mine.

Hope this helps. There are a couple of things here that will cost you time, but not attorney' s fees. I still think having your lawyer contact the idiots who' ve taken your material is the best route.

I' m a little upset about what happened to me, can you tell! :)

From Joe Burns:
quote:

You should place the circle C (©) and the word " copyright" plus the year and the name of the author. Like so:

This page © Copyright 1997, Dr. Joe Burns, Ph.D.
You may think you only need the circle c or the word copyright alone. But remember that the circle c is created in HTML through this command: & copy . That will not show as a circle c when the source code is printed. Put them both to be safe.
..............................Whether you do put the copyright on every page, or just the top level page, make a point of putting the copyright in the text so it shows when the page is displayed, and also put it in the HTML code. Like so:

<!-- This page Copyright 1997, Dr. Joe Burns, Ph.D. -->

Good idea to have that copyright in the coding also.... if the thieves sometimes forget to change a link or typos, there' s a good chance they won' t think to change the copyright that only shows in the html.

Your most effective remedy is under the Digital Millenium Copyright Act. Specifically, Title II of the DMCA (17 USC Sec. 512(c)) gives ISPs a " safe harbor" from copyright infringement suits. But they can only claim the protection of this safe harbor if they do not have actual or constructive notice of the infringement. Notify the ISP, in writing, of the infringement, and be as specific as possible. (In legal jargon, this is sometimes called a " cease and desist" letter). Provide the link to your site and the link to the infringing site. A smart ISP will respond by taking the infringing site down, temporarily or permanently. Failure to do so exposes the ISP to liability for contributory infringement under Title II of the DMCA. If you want more information, here' s a brief article I wrote about contributory infringement under the DMCA: http://cot.emich.edu/ray/May%202001-DMCA.pdf.

As a practical matter, this is likely to be your ONLY effective remedy. The creeps who steal content don' t have any money to pay you damages (if they had any money, they might not be so inclined to swipe stuff from others to begin with), so going after them will just cost you a lot of time and, more importantly, money that you' ll never recoup. The ISP, on the other hand, has a bit of a deeper pocket. ISPs don' t want to get sued for contributory infringement; it' s usually easier and cheaper for them to just take the site down.

Good luck, and let me know if I can provide any more information.

Hello,

I have tried well over 10 different types of *no right click* scripts
as I have on all my sites..1000' s of images. None of
them have ever been compatable in all browsers. They are buggy
and can keep people from being able to use your site properly.

There was a program out there that digitally signed images, but
when I went to windows200pro, it was not compatable. I can' t
remember the name, but if you want to check it out, I' ll snoop for it
again. :)

You could try digitally marking specific images etc to protect them from
theft, but to be realistic, people will take it anyway if they want it.

Copyright is great..in the *real world*..lol

I face these issues daily.

Good Luck! Kick some royal A**!!

Hi,

If you disable the right click you will not protect the images. I read it somewhere and they put the way to overcome this protection.

Magnolia, would you be willing to send me the URLs of those two SEOs who stole your content? If so, please send an email to magnolia(@)seoconsultants.com. I' d first like to make sure that niether of those two are in our database of reviewed consultants. If they are not, I want to make sure that they do not make it in! ;)

Thanks in advance!

P.S. There really is nothing you can do to prevent public information from being copied. Google takes a very strong stance against copyright infringement and if you document and prove your case to them, Google will delist the offending pages and post a link to the DMCA report in the SERPs (Search Engine Results Pages). They basically put the company who stole the content on the spot!

Disabling right click does not protect images.
