Is anyone on here especially knowledgeable about trademarks. I wish to register a few trademarks related to various business activites and projects. I have found all of the resources I need via govt sites. Most of the trademarks that I want are availabel (unregisterd), but one has been registered by a company that, from all appearances, is out of business.
Hypothetically, let' s say i registered a domain... widget.org Now, I wanted to register " widget" as my trademark. However, widget.com has already registered " widget" as a tm. They are, however, different companies and offer different services and information. Can two companies have a tm on the same name if they are in different industries? Also, what may be the legal ramifications?
Obviously, I am just looking for some general feedback and I won' t hold this a legal advice.
