I agree with both you and Douglas/ Actually his posting is a repost of an answer he gave me re a customer of mine who was suggestiong I advise him on SEO. I mentioned to my customer, during the presentation, that SEO was not included in the original quote (and I only mentioned it because he brought it up during our meeting). He later demanded support on that issue and I had to refer to the original presentation. He finally understood and we signed a different contract for SEO services. I can only imagine the madness of describing everything that is not included in a website design LOL We should definitely include this one: 34.4 f) Making your aunt Agnes actually love your site, is not included

Short contract, long and detailed product criteria. Beat the client over the head until you have a blueprint that can be implemented properly. If everything is clear from the start the likelihood of a legal fallout would seem low, and hence require less legalese.

Every project should have all the criteria spelt out ad nauseum at the beginning, and that is the real basis of any contract - what you provide for what cost and how long will it take.
