Does the UK Companies Act apply to voluntary organisati... - 7/31/2008 16:42:42
As I may have mentioned recently, I chair a small UK charity (currently unregistered as we're under the income threshold where there's a requirement to be registered). At the moment I'm having a bit of a row with our Secretary who says that on all the information leaflets we produce we have to have "Produced and printed by..." and all our contact details etc. Fair enough if we have to do it, but I'm not convinced, and suspect she's talking s***e so want to check out the situation as I really don't want to create unnecessary work for our committee member who does the designing of the leaflets and stuff for us (she's the only one that's got the Adobe software).

I know there was a thing about the scope of the Companies Act changing in 2007 to include a requirement for websites and electronic communications to include full contact details etc., but it's the Companies Act! Now we're not a company, and unless there's some obscure Act I've not heard of, I can't see anywhere where it says anything about charities etc. complying with it. Yes, if you're a registered charity probably the Charity Commission has some sort of ruling about displaying your registration number, but we're not a registered charity at the moment. There's an article about the Companies Act thing here: http://www.theregister.co.uk/2006/12/21/new_web_email_regulation/

Fair enough if we have got to include something, and I guess it might be good practice to include such stuff (though I've never seen anything like that on info leaflets produced by big charities, and surely if there was a requirement for charities to have such info on all their literature they'd know about it?) but I can't see the point of making extra work for our hard-pressed committee member who's already stressed because she's just started a new job, if it's not necessary.

Anyone know anything about this?

first off i have no idea whether this applies to unregistered charities but i'm just wondering how hard it is to add those details anyway as a footer in small (but accessible) print. would be interesting to know though...

Surely it makes good sense to put your contact details on everything you send out? If you make it difficult for potential donors to find you they won't.

I believe the legal requirement for companies is to give the registered office address, company registration number and vat number if relevant. There is no legal requirement to give phone/fax/email/website details but you'd be daft not to.

I don't always add the company number and vat number if it would compromise the design, and I don't think that is a major problem.

Preceding the information with "Produced and printed by..." is pretty naff and amateurish and should be avoided at all costs.

I do it for all my clients, voluntary, charity or not. The only difference is with the charity I put the charity number on there.

from that link jb
"It is not sufficient to include a 'contact us' form without also providing an email address and geographic address somewhere easily accessible on the site."

so you have to provide an email address that can be spidered and spammed?!!!

Depends on how you include the email address. There are various ways of providing one without leaving it open for scraping.
