copyright and other rights of ownership - 9/1/2008 7:38:54
i was just wondering on about the situation where a designer makes a site for a company and then after maintaining that site for a while is going to hand over the maintainence to another person.

do i assume rightly that the company owns the native files e.g. fireworks/psd layered/native files of graphic work such as headers, and therefore i need to hand them over to the new person, or do they just get what is online ot work with? (obviously not so easy for them to make changes to headers etc with specific text when they only have a flattened jpg to work with ;)

I guess it depends what you decided when you originally did the work. I put it in my contract that (unless I use my own templates) copyright of the site and it's contents reverts to the site owner upon completion of the site.

i didn't have a contract - only verbally and simply. it's not a problem though as i will hand over the files anyway. just had a bad day at work (without even being at work! my boys are ill) and my boss is being an a-hole.

one thing i'm supposed to do at work that would actually be nice is to be in the office for a day, or half a one, a week and update the web site.

now after the conversation on the phone this morning i'm thinking of saying he can either pay me my going rate (rather than the pittance thinly disguised as wages i receive for laminating boats) or he can find someone else. (or upgrade my job pay to reflect the job duties) i know for sure he won't want to pay me the extra on principle so i can bet it will be passed to someone else (who'll probably make a mess of it :)

Sorry to hear the boys are ill - it's horrible when kids get sick.

I'd suggest ensuring that you have a backup copy of all the files as they are currently. Then, if he decides to pass the site to someone else try if possible not to be territorial about it. If he's not paying you - (shrug) - let it go.

Seems to me that one of 3 things might happen:

1. He pays you extra
2. He won't pay you extra and passes the work to someone else who does it properly - but you're no worse off time-wise and financially
3. He passes the site to someone else who messes it up and then he has to either find someone else to do it or pay you extra to do it.

Any of these are fine. What's not fine is him taking advantage of you currently. If you're not happy then it has to change one way or another - you get either more money or more time.

It's hard not to be territorial about sites and it's hard to watch others mess it up.

those 3 options are pretty much what i envisaged.

although i do feel territorial about all my sites i would still be quite happy to hand it over, though it is nice to know it goes to a nice home ;)

You can't do that remotely?

I haven't been in anyone's office (except to buy insurance :)) in over a year. :)

Dave in your situation, if he hands it to somebody else then just give them the site as it is on the web. I've never been given all the working files when I've taken sites over.

You put a lot of hours into those graphics, he has the finals on the site. If he pays you for all the mock-ups etc then fine but freebies! and he's dumping on you at the same time! Forget it.
