rejected website ideas- who owns? - 10/18/2002 10:34:06
I had a bad experience with a client when we executed 3 design concepts she specified, and at the end she didn' t like what we had done. We got her to pay her bill and turned over all the pictures, files, graphics, etc. related to the construction of the last site concept. She ran the site for a few weeks, and then had someone do something completely different ( we had discouraged her desire to use flash extensively in a B2B site). My question is: could I use that same design concept for another client (it is a business in the same field as hers)? It really was a dynamite site, and I hate the thought that it would never see the light of day because of her " attitude" . But I also don' t want to incur legal wrath, because I am sure she would see the new site for her competitor and recognize what we had done (she knows we did the competitor' s original website). How would you proceed? Bigdoggy

Hi brc, You might want to take a look at this thread. It didn' t start on quite the same note but has turned slightly in your direction. Personally, if you have turned over all the pictures, files, graphics, etc. and have to create new ones for the new site then your only using the intellectual property (design) you developed anyway. On the other hand if you were to be using your former clients graphics, etc. that would not be Kosher. MHOO

You should definitely check out the thread above as suggested by Mike54. And I will add this, unless your contract (and hopefully you have one) states otherwise, you can use the design as it is your creation. Though I would refrain from using any of the particulars to the ' other' site such as similar buttons, clip art, etc.
